License and Disclaimer Agreement
General
The CARE software was developed with the partial support of funds provided by the National Highway Safety Administration and the State of Alabama, and thus is in the public domain and is to be used for the benefit of the citizens of the United States of America. It is not to be sold or in any other way restricted as to distribution for general use. It may be further reproduced and used in whatever capacity would be in the interests of traffic safety, provided that any such additional users understand and totally subscribe to this agreement.
No Warranties
The University of Alabama expressly disclaims any warranty that this software will perform as stated in its documentation or in any other related documentation. Absolutely no liability will accrue from the use of the findings of research based on information generated from the use of this software or from its accompanying documentation. The software is provided “as is” and there is no warranty, either express or implied, that it will perform a specific function or that it is fit for any given use.
No Liabilities For Damages
Those downloading CARE programs and data are hereby placed on notice that under certain operating systems and conditions of limited space availability it is conceivable that the installation of CARE can cause damage to existing programs and data. It is strongly recommended that before downloading CARE all data and software on the local machine be adequately backed up such that if any damage occurs it can be restored to its original condition without loss. In no event shall The University of Alabama, its employees, or its suppliers, be held responsible for any such losses. This agreement holds without limitation, and thereby includes hardware, software, data, loss of business profit, interruption of computational services or any other conceivable loss that could accrue from the installation and/or use of (or inability to use) this software and its accompanying data.
BY ACCEPTING BELOW YOU ARE ASSERTING THAT YOU HAVE READ AND FULLY UNDERSTAND AND AGREE TO THIS AGREEMENT. IF THIS IS NOT SO, DO NOT SELECT THE AGREEMENT LINE BELOW.
